Website Terms and Conditions of Sale

This legal notice applies to all purchases and sales made by you through the website under the domain name www.globalwhiskyauctions.com (“the Site”).
By offering to purchase or sell products through the Site "You", "Your", "Bidder", "Buyer", "Seller", "User" and "Yours" refers to you, the person registering to use the website and you accept you are entering into an agreement on the terms and conditions set out below with Global Whisky Auctions Ltd. 

Legal Age of Buyers and Sellers

Alcohol may only be purchased or sold by persons of 18 years and over in the U.K and also customers from foreign jurisdictions should abide by the ‘Legal Age’ for the country of residence. The Bidder and Seller (as the case may be) represent that: They are at least of Legal Age; and the person to whom any alcohol will be delivered is also of Legal Age. At the time of delivery, any shipment containing an alcoholic product will require the signature of an adult (of legal age) upon delivery.

Registration

In order to buy or sell through the Global Whisky Auctions website you are required to register on the website. You must be over the age of 18 years to do this. Your details must be kept confidential and are not to be shared with any third party. The liability shall lie with you if any bids are made through your account.

Registration to the website is completely free.

Bidding

Once you are fully registered and have an account with Global Whisky Auctions you will be eligible to place bids on the lots within an auction.

Placing a bid on a lot will be binding and you will be liable for the payment if your bid is the winning bid on any lot. By placing a bid you agree to the Terms & Conditions set out here and accept liability for all bids placed through your account.

Global Whisky Auctions reserve the right to reject registration and/or any bids placed and also to withdraw permissions for users of the site.

Bidding will be placed into the following increments of-

Sellers

Sellers listing fee is £3 per lot

Seller's Commission payable to the Company will be up to 10% of the final hammer price in any auction unless otherwise advertised on the Global Whisky Auctions home page in a period of promotion (e.g. introductory 0% Seller commission deal).

Seller's optional reserve fee is £4 per lot.

Sellers Buy It Now fee is £25 per lot

Global Whisky Auction reserves the right to change the sellers fee and any other fee should it be deemed fit.

VAT is applicable on all fees and surcharges, please note VAT is not applicable to the hammer price of the whisky.

By entering your bottle(s) to auction you agree to the auction fees this entails.

Multiple bottle lots are only available at the discretion of the auctioneer.

Global Whisky Auctions reserve the right to refuse to accept items to sell at auction if we believe that information concerning the lot given to us by you or on your behalf is inaccurate or misleading in any material respect or that the bottle(s) is a forgery.

Bell’s Decanters and cream liqueurs are not accepted for auction.

Global Whisky Auctions cannot be held responsible for any breakage or loss of bottles while in transit to our office in Glasgow City Centre. Insurance for this is left to the seller. Where the sellers have been offered a collection service and the auctioneer has provided transport of goods, they do so on the basis that Global Whisky Auctions will not be responsible for any damage or loss during transportation, with exception where it can be demonstrated that such loss has occurred as a direct result of negligence by employees or Directors of Global Whisky Auctions.

Any withdrawal of items from an auction must be at a minimum of 24 hours before the start of an auction. Any withdrawal of a lot after the start of an auction will incur a fee of 25% of the current bid on the lot.

Sellers are forbidden from bidding on their own bottles. Any bottles found to have been bid on by their owners or friends or family will be immediately withdrawn from the auction. In this event all auction fees will be kept and an administration fee of £30 will be charged on a per lot basis.

If the Reserve price, on any lot, is not met at the end of an auction, and the Lot remains unsold, Global Whisky Auctions will contact the Seller to arrange either to re-offer the unsold Lot in the subsequent auction, with the ability to change or remove reserve price or return to to Seller.

If the Seller request that any unsold Lot(s) be returned to them all costs associated with the return will be bourne by the Seller.

Buyers & Payment

If you are successful in the bidding of a lot, come the end of the auction, you will be liable for the buyers’ commission that is 10% of the final Hammer price on any lot you have won.

Our Unique Buy-it-Now option will allow you to make a fixed bid on a bottle (Buy-it-Now). The bottle will stay live in the auction until it is fully paid for so if you wish to choose this option please pay for the bottle straight away. Please note that this will only be available on specific lots chosen at the discretion of the auctioneer.

VAT is applicable on the Commission and any fees not on the Hammer price of the lot. VAT will not be charged on orders that are shipped outside the E.U.

Payments for won lots should be paid within five working days from the close of the auction. Additional 2% of the full invoice amount will be charged for payments not received in full within five working days of a winning bid. We have absolute discretion and can cancel the contract and offer the bottles in a subsequent auction if your invoice is not paid within the five days. We also reserve the right to cancel your registration. 

Invoices cannot be changed to indicate a lower value of any purchases in an auction and there are no exceptions. Please be aware of this before making any bids.

Credit Card has a 3% handling fee applied.

Paypal has a 3.4% handling fee applied.

Debit Card and BACS payments can be made at no charge.

International transfer fees are bourne by the buyer.

 

End of Auction

At the end of an auction if any of your bids are successful you will be notified through email and you will be liable for payment on any of these winning bids.

The buyer is responsible for making sure they choose the correct option for delivery or for collection at our Glasgow City Centre office.

Due to the various ages of bottles and their seals, condition of liquid is at the buyer's discretion and no claim can be lodged against failure/leakage in transit.

The buyer should make sure that before bidding on a lot they take into account the condition of said lot by the provided photographs on the website. If any further information is required please email info@globalwhiskyauctions.com and request any information they may need. No refund will be given if they are for clearly visible imperfections that are in the photos supplied.

N.B. The Consumer Protection [Distance Selling] Regulations 2000 do not apply to items sold by auction and are therefore not applicable to items purchased on this website.

Delivery charges will vary depending where you would like your bottle(s) to be sent.

Please be sure that the person who will be signing for the bottles is over 18 years of age .

Global Whisky Auctions cannot be held responsible for any leakage/damage in transit and insurance should be purchased to protect you against this eventuality. Any bottles that cannot be insured, Global Whisky Auctions will not be held responsible for any breakage or leakage in transit.

Insurance is optional and will be charged at 3%(Ex VAT) of the Hammer price (not including commission).

Global Whisky Auctions will not be responsible for any incursion of local taxes for bottles being shipped outside the U.K.

Invoices cannot be changed to indicate a lower value of any purchases in an auction and there are no exceptions. Please be aware of this before making any bids.

If your parcel is returned, we will give you the option of resending the parcel to you and the buyer will be responsible for any extra delivery charges accrued.

Please note that Global Whisky Auctions cannot be held responsible for any delays or seizures by customs or any other third-party, it is the customers’ duty to adhere to local customs, rules and laws for their own county.

We aim to deliver your bottles within 14 days of payment for your bottle(s).

Collection

Bottles will be available for collection for our Glasgow office in 111 West George Street, Glasgow, G2 1QX

We can store your lots for you for 30 days after the end of an auction after this period the lots will be subject to a £2 charge per day after this period.

 

Bottles offered for Auction

All information about bottles submitted by the seller must be accurate and truthful. Any information that is deemed to be false will result in the withdrawal of the bottle(s) from the auction. If there is any doubt about the authenticity of a bottle, it will not be offered for auction. In the event of a dispute arising over the provenance or authenticity of any bottle, if it cannot be proved to be genuine, it will be returned to the seller.  If we consider a bottle to be counterfeit or illegitimate to that described by the seller, Global Whisky Auctions reserve the right to reject and dispose of any item.  A charge of £10 will be made for the appropriate removal and destruction.  

Any risk, damage or loss of item will remain with the seller who should ensure that adequate insurance cover is provided until payment is made in full, at that point the buyer should have equal insurance preparations in place.

Seller Payments

All payments will be made to the seller after the buyer has paid and has accepted that the bottle descriptions given are accurate. Payments will be made up to 21 business days after the auction, if this is not possible the seller will be informed.

Payments can be made using direct bank transfer, Transferwise and PayPal . Any fees associated with receiving funds following the auction are borne by the seller.

Cancellations

Any withdrawal of items from an auction must be at a minimum of 24 hours before the start of an auction. Any withdrawal of a lot after the start of an auction will incur a fee of 25% of the current bid on the lot.

Under the Consumer Protection (Distance Selling) Regulations 2000 you have the legal right to cancel your order.  We require a maximum 24 hours’ notice of cancellation from the finish of the auction. We reserve the right to charge an administration fee for any cancellations.

You have the right to terminate any Services Agreement for any reason, including the ending of auctions that are already underway. No refunds shall be offered, where an auction is deemed to have begun and is, for all intents and purposes, underway. Any monies that have been paid to us which constitute payment in respect of the provision of unused services shall be refunded.

If you have received the goods before you cancel your contract, then you must send the goods back to our contact address at your own cost and risk. If you cancel your contract after we have already processed the goods for delivery, you should not unpack the goods when they are received by you and you must send the goods back to us at our contact address at your own cost and risk as soon as possible.

Customer Contract Regulations 2014 apply. Should an item not match the description or picture on our site, then the buyer has a 14-day cancellation period. Please contact as soon as possible after receiving the item and we will instruct you further

Once you have notified us that you are cancelling your contract, any sum debited by us from your credit or debit card will be re-credited to your account as soon as possible, and in any event within 30 days of cancellation.

Global Whisky Auctions have absolute discretion as to the date or dates on which goods can be put up for sale and divide any lot, to combine any two or more lots, or remove any lots from the sale, to remove bids, regulate bidding or cancel the sale without, in any case, providing a reason or previous notice.    

Global Whisky Auctions reserve the right to ban any user at any time. By bidding on a lot, there is a legally binding contract. In the event of non-payment or breach of this contract, bidders can be prevented from participating in future auctions at the discretion of Global Whisky Auctions. Any Customer refusing to pay on more than one occasion will be banned from the site immediately.  

Force Majeure

Neither party shall be liable to the other for any failure to perform (whether temporarily or permanently) any obligation under any Agreement which is due to a Force Majeure event which is beyond the control and without fault or negligence of the Party affected and which, by the exercise of reasonable diligence, the said Party is unable to provide against. For the purposes of this section, a Force Majeure event shall include but not limited to any Act of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made eventuality outside of our control,. For the avoidance of doubt, an inability to perform arising out of a lack of financial resources shall not constitute Force Majeure. Any Party affected by such event shall forthwith inform the Company of the same and the two shall agree a mutually acceptable course of action to minimise any effects of such occurence.
